These Terms and Conditions govern the provision of services by Digital Mock Service (“we”, “our”, or “us”) to schools or organisations (“the Client”, “you”).

By using our services, you agree to these Terms and Conditions.

1. Service Description

Digital Mock Service provides externally marked digital mock examinations and diagnostic assessments for UK secondary schools, including but not limited to GCSE and Cambridge National qualifications.

Services may include:

  • Assessment materials

  • Digital assessment delivery

  • Marking and feedback

  • Performance data reports

  • Communication relating to assessment delivery

2. Client Responsibilities

The Client agrees to:

  • Provide accurate student information where required

  • Ensure students access assessments under appropriate supervision

  • Use assessment materials for internal educational purposes only

  • Comply with applicable data protection regulations

The Client remains responsible for how assessment results are used within their institution.

3. Pricing and Payment

Pricing is provided on a per-student or per-script basis unless otherwise agreed.

Invoices must be paid within the payment period stated on the invoice (normally 30 days).

We reserve the right to suspend services where payment is overdue.

4. Turnaround Times

We aim to return marked assessments within the timeframe communicated at the time of booking (typically within 5 working days).

Turnaround times may vary depending on volume or unforeseen circumstances, and while we aim to meet stated timelines, they are not guaranteed.

5. Accuracy and Educational Use

Assessments are explained and marked using professional judgement aligned with exam-style standards.

However:

  • Results are indicative only

  • They do not constitute official examination outcomes

  • Digital Mock Service accepts no liability for decisions made based on assessment results

Schools retain responsibility for interpretation and use of data.

6. Intellectual Property

All assessment materials, mark schemes, feedback systems, and content provided remain the intellectual property of Digital Mock Service.

Materials may not be:

  • Shared externally

  • Resold

  • Uploaded to public platforms

  • Distributed beyond the purchasing institution

Without written permission.

7. Data Protection

The Client remains the Data Controller for student data.

Digital Mock Service acts as a Data Processor for the purpose of delivering services.

Data is handled in accordance with our Privacy Policy and UK GDPR principles.

8. Limitation of Liability

To the fullest extent permitted by law, Digital Mock Service shall not be liable for:

  • Indirect or consequential losses

  • Loss of data caused by client systems

  • Decisions made by schools based on assessment outcomes

  • Service disruption outside our reasonable control

Our total liability shall not exceed the amount paid for the relevant service.

9. Cancellation and Refunds

If services are cancelled before assessments are delivered, we will aim to provide a reasonable refund where costs have not been incurred.

Once assessments have been completed or marking has begun, refunds are normally not available.

10. Service Availability

We aim to provide reliable access to our platform and services. However, we cannot guarantee uninterrupted availability due to factors outside our control, including third-party technology providers.

11. Changes to Services

We reserve the right to make improvements or modifications to services where necessary to maintain quality and effectiveness.

12. Governing Law

These Terms and Conditions are governed by the laws of England and Wales.
